New York gunman left note declaring plan to kill people

NEW YORK (Reuters) - A gunman who killed two volunteer firefighters and wounded two others in a Christmas Eve ambush in upstate New York left a typewritten note declaring his plan to burn down his neighborhood and start "killing people," authorities said on Tuesday.

The gunman opened fire on volunteer firefighters who responded to a house fire he deliberately set early on Monday morning in Webster, New York, a suburb of Rochester, authorities said.

The gunman, William Spengler, 62, shot and killed himself in an ensuing gunfight with police. He had spent 17 years in prison for beating his 92-year-old grandmother to death with a hammer in 1981, authorities said.

Police said Spengler set the fire, laying a trap for the firefighters, and opened fire when they arrived.

He left a typewritten note describing his intent, Webster Police Chief Gerald Pickering said at a news conference on Tuesday.

"I still have to get ready to see how much of the neighborhood I can burn down and do what I like doing best, killing people," Pickering read from the gunman's statement.

Pickering said investigators are looking for Spengler's sister Cheryl, 67, who is missing and unaccounted for.

Spengler started shooting at arriving firefighters before they got out of their fire truck, Pickering said. He shot out the truck's windshield as they tried to drive away, he said.

"This was a clear ambush on first responders," Pickering said.

Police fired back at the gunman, he said.

"It was a combat condition. They were shooting at muzzle flash," Pickering said.

Spengler was in a natural depression in an embankment near a tree when he opened fire, he said.

Spengler's motive for attacking firefighters remained unknown, Pickering said. It may have been related to contributions his mother had made to the local fire department, he said.

Pickering said he was not sure what the victims were shot with but said Spengler had an "arsenal of ammunition" and three weapons - a Smith and Wesson .38 revolver, a pump action Mossberg shotgun, and a .223 Bushmaster rifle with a flash suppressor.

Authorities with the Bureau of Alcohol, Tobacco, Firearms and Explosives were checking on the origin of the weapons, he said.

As a convicted felon, Spengler could not legally own guns, but The New York Times reported there had been recent gun thefts in the county, citing local authorities.

A Bushmaster rifle was used in the killing of 20 students and six teachers in Newtown, Connecticut, on December 14.

The firefighters killed in the attack were Lieutenant Michael Chiapperini and Tomasz Kaczowka, authorities said.

The injured firefighters were identified as Joseph Hofsetter and Theodore Scardino. Both men were listed in guarded condition on Tuesday at Strong Memorial Hospital in Rochester.

An off-duty police officer was wounded by shrapnel as he drove past the scene. The officer was treated at a local hospital and released, the Times said.

Seven homes in the neighborhood were destroyed by the fire, and two were uninhabitable, authorities said.

Chinese medicine yields secrets: Atomic mechanism of two-headed molecule derived from Chang Shan, a traditional chinese herb

Dec. 23, 2012 ? The mysterious inner workings of Chang Shan -- a Chinese herbal medicine used for thousands of years to treat fevers associated with malaria -- have been uncovered thanks to a high-resolution structure solved at The Scripps Research Institute (TSRI).

Described in the journal Nature this week, the structure shows in atomic detail how a two-headed compound derived from the active ingredient in Chang Shan works. Scientists have known that this compound, called halofuginone (a derivative of the febrifugine), can suppress parts of the immune system -- but nobody knew exactly how.

The new structure shows that, like a wrench in the works, halofuginone jams the gears of a molecular machine that carries out "aminoacylation," a crucial biological process that allows organisms to synthesize the proteins they need to live. Chang Shan, also known as Dichroa febrifuga Lour, probably helps with malarial fevers because traces of a halofuginone-like chemical in the herb interfere with this same process in malaria parasites, killing them in an infected person's bloodstream.

"Our new results solved a mystery that has puzzled people about the mechanism of action of a medicine that has been used to treat fever from a malaria infection going back probably 2,000 years or more," said Paul Schimmel, PhD, the Ernest and Jean Hahn Professor and Chair of Molecular Biology and Chemistry and member of The Skaggs Institute for Chemical Biology at TSRI. Schimmel led the research with TSRI postdoctoral fellow Huihao Zhou, PhD.

Halofuginone has been in clinical trials for cancer, but the high-resolution picture of the molecule suggests it has a modularity that would make it useful as a template to create new drugs for numerous other diseases.

The Process of Aminoacylation and its Importance to Life

Aminoacylation is a crucial step in the synthesis of proteins, the end products of gene expression. When genes are expressed, their DNA sequence is first read and transcribed into RNA, a similar molecule. The RNA is then translated into proteins, which are chemically very different from DNA and RNA but are composed of chains of amino acid molecules strung together in the order called for in the DNA.

Necessary for this translation process are a set of molecules known as transfer RNAs (tRNAs), which shuttle amino acids to the growing protein chain where they are added like pearls on a string. But before the tRNAs can move the pearls in place, they must first grab hold of them.

Aminoacylation is the biological process whereby the amino acid's pearls are attached to these tRNA shuttles. A class of enzymes known as aminoacyl-tRNA synthetases is responsible for attaching the amino acids to the tRNAs, and Schimmel and his colleagues have been examining the molecular details of this process for years. Their work has given scientists insight into everything from early evolution to possible targets for future drug development.

Over time what has emerged as the picture of this process basically involves three molecular players: a tRNA, an amino acid and the aminoacyl-tRNA synthetase enzyme that brings them together. A fourth molecule called ATP is a microscopic form of fuel that gets consumed in the process.

The new work shows that halofuginone gets its potency by interfering with the tRNA synthetase enzyme that attaches the amino acid proline to the appropriate tRNA. It does this by blocking the active site of the enzyme where both the tRNA and the amino acid come together, with each half of the halofuginone blocking one side or the other.

Interestingly, said Schimmel, ATP is also needed for the halofuginone to bind. Nothing like that has ever been seen in biochemistry before.

"This is a remarkable example where a substrate of an enzyme (ATP) captures an inhibitor of the same enzyme, so that you have an enzyme-substrate-inhibitor complex," said Schimmel.

If you were wondering whether or not the ZTE Grand X would cross the oceans to launch in the US, there's a good chance the mystery is over. An unusually detailed FCC filing has uncovered a V970T variant that's destined for T-Mobile USA, complete with the carrier branding, Wi-Fi calling and AWS-based 3G data to match. Other details of the Android 4.0 phone are lacking despite the presence of a manual, although the V970 edition we've seen elsewhere runs on a dual-core, 1GHz MediaTek MT6577 chip alongside the more familiar 4.3-inch screen and 5-megapixel rear camera. T-Mobile's release plan is about all that's left to ponder; knowing the entry-level components, though, any possible launch should come with a low price tag.

As 2012 comes to a close, hype begins to rise for some big 2013 releases. One of the biggest is going to be Grand Theft Auto 5, officially revealed a couple of months ago. The new entry will bring some long awaited changes in the formula, couples with the return to the city of Los Santos which players have already visited in GTA: San Andreas.

Rockstar games, after some promo material leak, confirmed a Spring 2013 release window, making pre-orders start. And now it seems like we finally have a release date, though it still needs official confirmation.

As reported by oxgn.com, Amazon has started sending emails to all who preordered the game stating that the game will be released on March 26th. If you go check out their listing on the site, the release date still is a generic Spring date but it?s probably gonna be changed soon.

It?s not the first time Amazon creates some release dates out of the blue, but this seems realistic enough for a lot of reasons: the confirmed Spring release, March 26th is a Tuesday, when games do get released in North America. With GTA 4 getting released in April, back in 2008, this March 26th seems like it could be the true release date.

Rockstar still has to comment about this tentative release date: we?ll keep you all updated on the matter.

Grand Theft Auto 5 will launch on Ps3 and Xbox 360, with a possible Pc release.

Kathy Freston: A Vegan Diet (Hugely) Helpful Against Cancer

If you're anything like me, the "C" word leaves you trembling. But today there is very good news to report: Research suggests you can improve your odds of never getting cancer and/or improve your chances of recovering from it. Not with a drug or surgery, although those methods might be quite effective. This is all about the power on your plate, and it's seriously powerful.

A 2012 analysis of all the best studies done to date concluded vegetarians have significantly lower cancer rates. For example, the largest forward-looking study on diet and cancer ever performed concluded that "the incidence of all cancers combined is lower among vegetarians."

That's good news, yes. But what if we're looking for great news? If vegetarians fare so much better than meat-eaters, what about vegans? Is that an even better way to eat? We didn't know for sure until now.

A new study just out of Loma Linda University funded by the National Cancer Institute reported that vegans have lower rates of cancer than both meat-eaters and vegetarians. Vegan women, for example, had 34 percent lower rates of female-specific cancers such as breast, cervical, and ovarian cancer. And this was compared to a group of healthy omnivores who ate substantially less meat than the general population (two servings a week or more), as well as after controlling for non-dietary factors such as smoking, alcohol, and a family history of cancer.

Why do vegans have such lower cancer risk? This is fascinating stuff: An elegant series of experiments was performed in which people were placed on different diets and their blood was then dripped on human cancer cells growing in a petri dish to see whose diet kicked more cancer butt. Women placed on plant-based diets for just two weeks, for example, were found to suppress the growth of three different types of breast cancer (see images of the cancer clearance). The same blood coursing through these womens' bodies gained the power to significantly slow down and stop breast cancer cell growth thanks to just two weeks of eating a healthy plant-based diet! (Two weeks! Imagine what's going on in your body after a year!) Similar results were found for men against prostate cancer (as well as against prostate enlargement).

How may a simple dietary change make one's bloodstream so inhospitable to cancer in just a matter of days? The dramatic improvement in cancer defenses after two weeks of eating healthier is thought to be due to changes in the level of a cancer-promoting growth hormone in the body called IGF-1. Animal protein intake increases the levels of IGF-1 in our body, but within two weeks of switching to a plant-based diet, IGF-1 levels in the bloodstream drop sufficiently to help slow the growth of cancer cells.

How plant-based do we need to eat? Studies comparing levels of IGF-1 in meat-eaters vs. vegetarians vs. vegans suggest that we should lean toward eliminating animal products from our diets altogether. This is supported by the new study in which the thousands of American vegans studied not only had lower rates of obesity, diabetes, and hypertension, but significantly lower cancer risk as well.

This makes sense when you consider the research done by Drs. Dean Ornish and Nobel Prize winner Elizabeth Blackburn; they found that a vegan diet caused more than 500 genes to change in only three months, turning on genes that prevent disease and turning off genes that cause breast cancer, heart disease, prostate cancer, and other illnesses. This is empowering news, given that most people think they are a victim of their genes, helpless to stave off some of the most dreaded diseases. We aren't helpless at all; in fact, the power is largely in our hands. It's on our forks, actually.

(AP) ? With defeat in the Michigan Legislature virtually certain, Democrats and organized labor intend to make enactment of right-to-work laws as uncomfortable as possible for Gov. Rick Snyder and his Republican allies while laying the groundwork to seek payback at the polls.

Shellshocked opponents of the laws spent the weekend mapping strategy for protests and acts of civil disobedience, while acknowledging the cold reality that Republican majorities in the House and Senate cannot be stopped ? or even delayed for long by parliamentary maneuvers. Leaders vowed to resist to the end, and then set their sights on winning control of the Legislature and defeating Snyder when he seeks re-election in 2014.

"They've awakened a sleeping giant," United Auto Workers President Bob King told The Associated Press on Saturday at a Detroit-area union hall, where about 200 activists were attending a planning session. "Not just union members. A lot of regular citizens, non-union households, realize this is a negative thing."

Right-to-work laws prohibit requiring employees to join a union or pay fees similar to union dues as a condition of employment. Supporters say it's about freedom of association for workers and a better business climate. Critics contend the real intent is to bleed unions of money and bargaining power.

Hundreds of chanting, whistle-blowing demonstrators thronged the state Capitol last week as bills were introduced and approved hours later, without the usual committee hearings allowing for public comment. Even more protesters are expected Tuesday, when the two chambers may reconcile wording differences and send final versions to Snyder, who now pledges to sign them after saying repeatedly since his 2010 election the issue wasn't "on my agenda."

In Kalamazoo on Sunday, union protesters sang Christmas-themed songs attacking Snyder and Republican lawmakers and left a bag of coal outside the office of state Sen. Tonya Schuitmaker, a bill backer.

Republicans are betting any political damage will be short-lived. During a news conference with GOP leaders last week announcing their intent to press ahead with right-to-work measures, Snyder urged labor to accept the inevitable and focus on showing workers why union representation is in their best interest.

"Let's move forward, let's get a conclusion, let's get an answer and get something done so we can move on to other important issues in our state," he said.

On that point, at least, the governor won't get his way. Unions and their Democratic allies say this means war.

Allowing employees to opt out of financially supporting unions while enjoying the same wages and benefits as members undermines the foundation of organized labor, they contend. A UAW bulletin described it as "the worst anti-worker legislation Michigan has ever seen."

"You will forever remember the day when you thought you could conquer labor," Sen. Coleman Young II, a Detroit Democrat and son of the city's fiery late mayor, boomed during floor debate Thursday. "Be prepared to engage in the fight of your life."

But for all the defiant rhetoric, the opposition faces tough odds.

State law forbids repealing spending bills through referendums, and Republicans made the right-to-work measures immune by attaching a $1 million appropriation. So the only apparent way to nullify the policy, once enacted, will be to seize statehouse control through the ballot box.

Even after losing five House seats in November, Republicans will retain majorities in both chambers for the next two years ? during which time they expect voter attention to turn to other topics. They redrew district lines in their favor after the 2010 Census, boosting their long-term prospects.

Also, as Snyder noted, fewer than 20 percent of Michigan workers are union members. Organized labor rolls and influence have declined in recent years, emboldening Republicans to challenge unions even in their historic Rust Belt stronghold.

Wisconsin Gov. Scott Walker survived a recall attempt after curtailing collective bargaining for most public employees. After Indiana enacted a right-to-work law this year, voters in November gave Republicans a legislative majority so large they can conduct business without any Democrats present. Snyder and GOP lawmakers already had chipped away at Michigan union rights, even forbidding school districts from deducting dues from teachers' paychecks.

Another problem for opponents: Right-to-work has considerable voter support. A statewide phone survey of 600 likely voters conducted in late November by the Lansing firm EPIC-MRA found 54 percent favored the idea while just 40 percent opposed it, although they were evenly divided when asked whether Michigan should become the 24th state with such laws. The margin of error was plus or minus 4 percentage points.

Senate Majority Floor Leader Arlan Meekhof, straining to be heard over jeering opponents in the chamber's gallery, argued last week that by enacting right-to-work, "we are announcing to the world that we are moving Michigan forward. We are for workplace fairness and equality and we are for job creation."

To go up against all those obstacles, unions and Democrats will need solid organization, steadfastness and a persuasive case.

Democratic U.S. Rep. Sander Levin, who as a state legislator in the 1960s sponsored the labor law that right-to-work measures would overturn, called for a "massive education campaign" to remind voters of unions' role in building the middle class and explain how the new policy will weaken their ability to bargain for good wages and benefits.

"What's at stake is the cooperative, constructive labor-management relations that have ripened over the last 15 to 20 years," Levin said. "This governor is essentially saying that instead of collaboration, it's going to be dog-eat-dog."

Michigan Education Association President Steve Cook said Republicans pushed the one issue guaranteed to unite an often fractious labor movement.

Activists have filed a lawsuit claiming the state Open Meetings Act was violated when police temporarily barred doors to the Capitol during last week's debate. Other legal challenges are being considered, opponents said. Union members distributed leaflets Saturday at a college basketball game in the Upper Peninsula city of Marquette.

That's only the beginning, Cook said. While declining to discuss specific plans, he vowed labor would fight hard to unseat right-to-work supporters in 2014 and might try to recall some legislators even earlier.

"Whoever votes for this," Cook said, "is not going to have any peace for the next two years."

New talks on Syria involving Russia, US

MOSCOW (AP) ? Russian and U.S. diplomats are meeting Sunday with U.N. peace envoy Lakhdar Brahimi for more talks on the civil war in Syria, Russian Foreign Minister Sergey Lavrov said, adding that the Americans were wrong to see Moscow as softening its position.

Russia agreed to take part in the talks in Geneva, he said, on the condition there would be no demand for Syrian President Bashar Assad to step down.

"We are not conducting any negotiations on the fate of Assad," Lavrov said Sunday. "All attempts to portray things differently are unscrupulous, even for diplomats of those countries which are known to try to distort the facts in their favor."

Lavrov met last week with Brahimi and U.S. Secretary of State Hillary Rodham Clinton in Dublin. Afterward, Clinton said the United States and Russia were committed to trying again to get both sides in the Syrian conflict to talk about a political transition. Clinton stressed that the U.S. would continue to insist that Assad's departure be a key part of that transition.

Russia and the United States have argued bitterly over how to address the conflict, which began with peaceful protests against Assad in March 2011 and escalated into a civil war that has killed an estimated 40,000 people. The U.S. has criticized Russia for shielding its closest ally in the Middle East, while Moscow has accused Washington of encouraging the rebels and being intent on regime change.

Russia's foreign minister said Sunday that after he agreed to a U.S. proposal to have his and Clinton's deputies "brainstorm" on Syria, the Americans began to suggest that Russia was softening its position.

"No such thing," Lavrov said. "We have not changed our position."

He urged the international community to come together and "with one voice" to demand a ceasefire, return U.N. observers in bigger numbers and begin a political dialogue. Lavrov repeated that Russia was not wedded to Assad but believed that only the Syrians have the right to choose their leaders.

Germany weighed in Sunday on the future of Assad's regime, with Federal Intelligence Service chief Gerhard Schindler saying it would not survive, although it was impossible to say how long it would hang on.

"Signs are increasing that the regime in Damascus is in its final phase," he was quoted as telling the Frankfurter Allgemeine Sonntagszeitung.

Assad's regime appears increasingly embattled, with rebels making gains in northern Syria and near Damascus, the capital.

Addressing fears that Assad could use chemical weapons in a last-ditch effort to save his regime, Lavrov once again said the Syrian government has given assurances that it has no intention of ever using the weapons of mass destruction. He said the greatest threat is that they would fall into the hands of militants.

Lavrov said Russia takes seriously any rumor about Syria's chemical weapons and immediately clarifies the situation with the Syrian government, passing on any information to the Americans.

A letter by the EU patent rapporteur? | ACTA

A letter allegedly written by European Parliament rapporteur Rapkay defends the unitary patent. I do not know whether the letter is real, or fake. I asked Mr Rapkay, no confirmation or denial yet. Whether written by the rapporteur or not, the letter gives insight in the proponents? arguments.

The letter actually confirms the doubts about the unitary patent. With this patent package, the EU leaves the competence to grant patents at the European Patent Office, with no say in the matter. The regulation grants a unitary effect to the European patent, without the EU having any influence on the process. A non EU title is upgraded to an EU title, but the EU never puts a stamp on it. The EU will not even have an office to do this. No competence for EU Court of Justice. The EU will automatically import foreign titles.

Or, is the unitary patent not an EU title? Then article 118 TFEU can not be used, and why does the EU create a court for a non EU title?

The letter says that by the compromise, the European Court of Justice is not excluded from interpreting EU law including the regulation on the unitary patent. Right, but the letter conveniently does not mention there is hardly EU patent law, so the EU court?s competence is very, very limited.

The EU outsources its patent law to a captive incrowd, while patents can be a matter of life and death, like in medicines, seeds and our ability to fight climate change; and innovation is strategically important.

The letter:

Dear comrades,

A couple of days ago, Mrs Lichtenberger has sent a so-called ?open
letter? to the MEP regarding the Unitary Patent. She put forward
some arguments in this letter which are not true.

I would like to make a couple of remarks on her argumentation:

* The rapporteurs on the patent package had a mandate to
negotiate, adopted by the JURI committee.
* As regards the compromise found, the EU will not delegate
competence and power in this area to the European Patent Office
(EPO). EPO would not have the power to grant unitary patents.
All the regulation does, is to grant a unitary effect to the
European patent. This has nothing to do with the EPO competence.
* The compromise on the table was not ?imposed by the Council?. To
the contrary, the council has tabled what we as EP have asked it
to table.
* By this compromise, the European Court of Justice (ECJ) is not
excluded from interpreting EU law including the regulation on
the unitary patent.
* The ECJ?s task though will not be to take final decisions on
patent disputes, because this would not be compatible with EU
law, as the EJC has stated already. The ECJ?s task is the
interpretation of EU law!
* It is not true that there is a ?strong presumption among experts
that the regulation does not comply with Article 118 TFEU?. The
paper written by the Max-Planck-Institute was written before the
compromise on the table was found and article 5 was inserted. In
addition, the EP legal service has put forward supportive
arguments for that compromise as well during the JURI committee
meeting. Article 5 contains an referral to art. 14 f-h of the
UPC-agreement regarding the acts which the patentee can stop
with his right to prevent. Therewith art 118 as legal basis can
be considered as given.
* The new system of rules would not be ?incoherently spread across
a myriad of legal regimes?. The new article 5 contains the
referral to the UPC-Agreement which in articles 14f-h ensures
that the rules are the same in every member state.
* In addition, the limitations laid down in the regulation will
now be completely incorporated into the UCP-agreement. These
provisions are identical to those that had been in the
regulation before. A ?breeders? exemption? is also part of these
limitations, therefore the EP resolution has not been ignored.

Knowledge is power for survival when it comes to overcoming disasters. It is vital to get educated on how to survive in the event of a myriad disaster scenerios. Many people die or get injured because they did not adequately plan, prepare or mitigate for unseen emergencies. In order to win the war on disasters; American citizens must take disaster preparation seriously and strengthen themselves mentally, spiritually, and physically to overcome the challenges in the future.

The Federal Emergency Management Agency states on their website that there are actions that should be taken before, during, and after an event that are unique to each hazard. Each person or group should identify the hazards that have happened or could happen in their area and plan for the unique actions for each hazard. They further note that mitigation can be defined as actions to reduce loss of life and property by decreasing the impact of disasters.? What this means is??taking action now??before the next disaster?to reduce human and financial consequences later (analyzing risk, reducing risk, insuring against risk).? Effective mitigation requires that we all understand local risks, address the hard choices, and invest in long-term community well-being. Without these actions, people jeopardize their safety, financial security, and self-reliance and quality of life.

Building an emergency kit with first aid equipment and taking medical classes are best practices in mitigation that can assist in reducing risk and loss to families and the community.? It is important to analyze what type of hazards would affect the community during a disaster, as well the decision to shelter in place or evacuate to a safe location.? By following this risk analysis process, it would help clarify what type and size of container or bag to place first aid items inside, the quantity, what too and what not to pack, where to pack it, the environment, hazard scenario and number of people it can provide care too. Your first aid kit or emergency supplies should be designed around an all hazards approach that insures against the risk of not being able to treat or prevent hazards from overtaking you and your group. These hazards can cause temporary or permanent damage to the critical infrastructure of this nation. Therefore everyone should be a stakeholder in public safety and security of this nation. As a result, many are designing their first aid kits around temporary disaster events where there is a short recovery period, while others are preparing their kits for a total collapse of the system where medical resources will be hard to find.

Caution: for medical legal and health safety reasons-Disaster Preparers should think about:

  1. Preparing physically, mentally, and spiritually now to adapt to changes caused by impact of disasters and?continuity of civil and infastructure recovery.
  2. Familiarizing with their local, state and federal laws on the boundaries of giving care to humans, pets and livestock.
  3. Getting prior training on how to use the items in the first aid kit.
  4. Working as a trained and covenant group, not loner.
  5. Trying to get written certification or medical authority to perform certain procedures.
  6. Not going beyond their scope of practice or their medical certifications.
  7. Abiding by the local laws of what is allowed in your first aid or medical kit.
  8. (Personal, Force, Asset?Protection)Avoiding making themselves a target for thieves, murderers, drug addicts that use false emergency scenes or requests for help.

A first aid kit can be purchased at many stores, disaster preparedness organizations and online merchants. Medical supplies can also be purchased individually to build your own kit.? Some have also combined the two as one mitigation measure. Others have crafted their own replacement first aid products by improvising. They use tampons for bleeding, card board for splints, and other homemade items, or pet supplies for their kit?s inventory. The real issue is finding the right items and kit skin for your needs. There are many questionable claims to first kits such as the number of people that it can actually treat in an emergency, the quality, sterility and durability of items, the protective covering of the container or bag and excessive prices for minimal supplies. This is why it is vital to do a risk analysis and make appropriate mitigation decisions for your own needs from an all hazards approach.

The first aid kit should be stored in a place that is of the right temperature for medical supplies, in a safe location, away from pests, where no damage can occur, can be accessible to adults, but not to children or pets that can be poisoned and injured.

Apple holds back S&P, Nasdaq; Dow ends higher

(AP) ? Apple spoiled the stock market's party on Friday.

Stocks shot higher in the early morning, after the government reported that the U.S. added jobs in November. But Apple, which has been flailing in recent weeks as investors wonder how long its momentum can continue, dragged down the indexes that it's part of.

The Dow Jones industrial average, which doesn't include Apple, rose. The Standard & Poor's 500 and Nasdaq, which do, were less impressive. The S&P rose by a smaller amount, and the Nasdaq fell.

The headline numbers from the jobs report sent the market higher in early trading. The Labor Department said the U.S. added 146,000 jobs last month, more than economists had expected. The unemployment rate fell to 7.7 percent from 7.9 percent, the lowest in nearly four years.

The overall report, however, painted a more restrained view of the economy.

"If you delve into that report a little more, there are some disturbing issues," said Brian Lund, who is based in Los Angeles as executive vice president and co-founder of the online brokerage Ditto Trade.

Among them: The unemployment rate fell largely because discouraged unemployed workers stopped looking for work, which meant they were no longer counted among the unemployed. Also, the Labor Department revised previously released jobs numbers downward, saying that employers added 49,000 fewer jobs in October and September than initially estimated.

Lund also wasn't so sure about the government's statement that Hurricane Sandy "did not substantively impact" the unemployment numbers. He expected Sandy's detrimental effects to show up in jobs reports over the next couple of months, as businesses figure out their post-storm plans.

"If you have Sandy, you don't automatically lose your job," Lund said. "Businesses take time to say, 'Oh, what's going on, can we go forward, do we need to cut people to survive? It's not until later that they start laying off."

Nicholas Colas, chief market strategist for ConvergEx in New York, was similarly unimpressed by the jobs numbers. In a note to clients, he said U.S. unemployment seems to be more consistent with "an ongoing recession than expansion."

In the recession of the early 1990s and its aftermath, the highest rate of unemployment was 7.8 percent. In the recession of the early 2000s and its aftermath, the unemployment rate never got above 6.3 percent.

This time has been harsher. In late 2009, shortly after the recession officially ended, the unemployment rate peaked at 10 percent. For two years after that, it stayed above 9 percent.

At the end of the day, the Dow was up 81.09 points to 13,155.13. The S&P 500, where Apple's weight is 4 percent, was up but by a smaller proportion, rising 4.13 to 1,418.07. The Nasdaq composite index, where Apple accounts for a hefty 12 percent, fell 11.23 to 2,978.04.

Apple fell $13.99 to $533.25, or 2.6 percent. That's part of a longer trend: Apple's stock has plunged nearly 24 percent since the iPhone 5 went on sale Sept. 21. Investors are wondering how long the company can keep the momentum going with its popular iPhone and iPad devices.

Outside of Apple, there's another significant cloud hanging over the market. Congress and the White House are trying to hammer out an agreement on government spending and tax rates before Jan. 1. If they don't, lower government spending and higher taxes will kick in, a situation that's been nicknamed the "fiscal cliff."

The fiscal cliff is already taking a toll on people's confidence and making them nervous about spending, said Bernie Williams, vice president of discretionary money management at USAA Investments in San Antonio, Texas. He pointed to recent announcements from retailers like Target and Kohl's, both of which reported lower November sales, even though analysts had expected increases.

"There are more things on the plate to worry about than normal," Williams said. "The consumer is weak, their confidence is being hit by the fiscal cliff, and then more importantly, you look ahead to next year and all the taxes are (likely) rising. ... If you're a paycheck-to-paycheck person, that's going to hurt."

Traders have been indecisive as well. In the 22 trading days since the presidential election, the Dow has been up 11 and down 11.

AIG, the bailed-out insurance company, rose more than 2 percent, up 87 cents to $34.13. A group of Chinese companies is in talks to buy AIG's aircraft leasing unit, which could help AIG raise cash to pay off more of its government loans.

The yield on the benchmark 10-year Treasury note rose to 1.63 percent from 1.59 percent late Thursday, a sign that investors were putting more money in stocks.

RICHMOND, Va. (WTVR) ??Lisa Thalhimer?s friends and family say she handled many things in life with a great sense of humor.

?No matter what she was going through, she had something funny to say,? says Lisa?s friend Claudia Biegler.

?She was funny and had a great sense of humor,? says her husband of 35 years Bobby Thalhimer.

Thalhimer can relive his wife?s wit through emails she wrote as she fought a very aggressive form of breast cancer called Triple Negative Breast Cancer.

She was diagnosed in December 2008. It was spotted on a mammogram, but Thalhimer says her doctor didn?t think it was cancer and said she could wait three months before having it checked again.

But the tumor grew rapidly and a biopsy revealed it was, in fact, cancer. Thalhimer says Lisa started emailing family and friends almost immediately.

Lisa was a creative writer and Thalhimer says the emails were some of her best writing.

??It was entertaining, ?said Thalhimer.? ?We learned how her chemo visits were turning into parties. Some of the funny things that would happen.?

They also chronicled Lisa?s struggles during treatment, both the physical and emotional.?? In one called ?Shaking the Daisy?s Neck,? she wrote about wanting to strangle a smiling daisy on a hat she?d been given, but instead learned a greater lesson.

Lisa wrote, ?The Happy-Face Daisy and I are friends again. I just needed to change my thinking. An hour of writing and Mission Accomplished!?

?It was a moment of revelation for her that she had to be responsible for how she was going to handle this even though she was feeling awful,? said Thalhimer.

Lisa handled many tough treatment decisions with humor as well.

?Ta-ta to the Tatas!? was an email she wrote about the choice to have a double mastectomy to reduce her chances for reoccurrence.

She wrote, ?I hate to see them depart without a tribute to the girls. They?ve been with me so long, showing up at such an early age when I was still a tomboy and furious that I could no longer play shirtless.?

?She decided if that?s what it takes to survive that?s what I want to do,? said Thalhimer.

But Lisa didn?t survive. She died from breast cancer in the spring of 2010. She was 55 years old. But she lives on in her emails.

?Reading them every night was like looking into her soul,? said Biegler.
Biegler was one of several friends who gave Lisa?s emails to Bobby as a gift.

?It was her book. And she always said she was going to write a book, ? said Biegler.

They are a book now, sort of.? Bobby created an online manuscript that helps raise money for one of Lisa?s other passions ? children?s literacy.

He says readers will also discover another part of Lisa?s legacy, a reminder of the importance of early detection. ??While Lisa?s cancer was diagnosed at a later stage, her sister?s was caught much earlier.

?Early detection can make a difference,? said Thalhimer. ?If her story helps with that, then it?s worth telling over and over again.?
